According to Circuit Clerk Connie Carr, Judge Joseph Pomponio presided over hearings and arraignments on Thursday, April 26.
State vs. George T. Underwood. Underwood, 32, of Marlinton, was willing to stipulate to violation of bond, and asked for a waiver of his hearing. Underwood was reinstated to bond with the added condition of Day Report. He is charged with third offense DUI.

State vs. Patrick Wall. Wall, 33, of Marlinton was placed on Day Report until space at Anthony Correctional Center is available. Wall stipulated to violation of his bond. He is charged with possession of a controlled substance, with intent to deliver.
State vs. Greg C. Sharp. Sharp did not appear for the scheduled status conference. After giving the defendant more time to appear, Pomponio issued a bench warrant for Sharp's arrest. Sharp, 27, is charged with fleeing while DUI.

Arraignments

State vs. Phillip A. Moyers. Moyers pled not guilty to all counts of his indictment, which are failure to provide support to a minor, grand larceny, receiving or transferring stolen goods and being a principal in the second degree. Trial was set for July 26. Moyers remains on bond.

State vs. Bryan Dewitt Thompson. Pomponio denied a motion to dismiss all charges against Thompson, 50, of Hillsboro, after Prosecuting Attorney Donna Price argued that he had left this jurisdiction at the time of his indictment and had not been located until last year. Price further argued that the charges are still active because Thompson had not beenᅠarraigned.Thompson pled not guilty to conspiracy to commit a felony and delivery of a controlled substance. Trial was set for July 26. Thompson is lodged in the Tygarts Valley Regional Jail in lieu of $50,000 bond.

William Cassell, 51, Cass, pled guilty to misdemeanor domestic battery, instead of felony domestic battery, as was reported in this newspaper two weeks ago. We apologize for the error.
