Circuit Court News

Judge Joseph Pomponio was on the bench in Pocahontas County Wednesday, May 2, according to Circuit Clerk Connie Carr.

Alan Thomas Woodward waived his right to a hearing and accepted extradition to Frederick County, Virginia, on a charge of probation violation. Woodward was held at Denmar Correctional Center until the State of Virginia could retrieve him.

State vs. Randall Bibb. Pomponio dismissed the indictment against Bibb after his attorney, Dewitt Daniell, indicated that it contained two charges and was not clear as to a specific charge, and therefore, could not be brought properly before a grand jury. Prosecuting Attorney Donna Price said she was willing to amend the indictment, but Daniell argued that the indictment was not eligible to be amended. Bibb, 59, of Marlinton, was indicted for sexual abuse in the first degree.

State vs. Haven Nicole Hall. Price told the Court the matter can be resolved by a plea without trial in Magistrate Court. A status hearing was set for June 13. Hall, 34, is from White Sulphur Springs.

State vs. Kelley Cohenour. Cohenour stipulated to violating the conditions of her bond. Price did not object to her being reinstated to her bond with the added condition of home confinement. Pomponio allowed Cohenour to be placed on unsupervised home confinement until Friday when she was to become monitored. Cohenour, 35, of Marlinton, was charged with four counts of possession with intent to deliver.
