Durbin man dead after shooting incident
A Durbin man died Tuesday afternoon as a result of a Monday night shooting incident in the town.
Jesse Bennett, 20, died at Ruby Memorial Hospital in Morgantown, according to a media release from Prosecuting Attorney Donna Price.
Charles Edward Stull, 49, is in the Tygarts Valley Regional Jail in lieu of $116,000 bond, charged with manslaughter, four counts of wanton endangerment and being a prohibited person in possession of a firearm.
Stull was previously convicted of a domestic violence charge and cannot have firearms.
According to the arrest report, Stull said the shooting was an accident and he did not realize the weapon was loaded. Stull told officers he was モshowingヤ Bennett his new gun, a .22, when it discharged, the arrest report said. The incident occurred in Stullメs apartment, according to Priceメs media release.ᅠ He was later found to have aᅠ blood alcohol content of .085, the arrest report said. Law enforcement officers recovered a spent shell from a .22 and one round of live ammunition for the same caliber weapon, according to the arrest report.
Bennett was wounded in the chest area, according to the report.
No preliminary hearing has been scheduled on the felony counts.
The incident is being investigated by the Marlinton Detachment of the West Virginia State Police and the Pocahontas County Sheriffメs Department.
