Magistrate Court
According to Magistrate Court records, the following individuals were either arrested or had activity in their cases.
Charles Morgan Burgess, 58, of Buckeye, was arrested August 14 on a charge of cruelty to animals. Bond was set at $1,000.
Phillip C. Dean, Jr., 37, of Marlinton, appeared in court August 19 on charges of contributing to the delinquency of a minor and child abuse resulting in injury. Bond was set at $26,000.
Stacy Lynn Friel, 26, of Marlinton, was arrested August 16 on a charge of contributing to the delinquency of a minor. Bond was set at $1,000.
Louis P. Cervone, 55, of St. Albans, was arrested August 16 on a charge of domestic battery. Bond was set at $2,500.
Charles Emory Miller, 28, of Marlinton, was arrested August 7 on a charge of possession of a controlled substance, less than 15 grams. Bond was set at $500.
Jonathan Carl Shearer, no age available, of Marlinton, was arrested August 5 on a charge of possession of a controlled substance, less than 15 grams. He was placed on unsupervised probation to expire February 20, 2011.
In Magistrate Kathy Beverage's court:
Chess M. Lee, 22, of Salem, Virginia, was arrested August 21 on a charge of conspiracy. Bond was set at $10,000. A charge of counterfeiting was dismissed August 23 by motion of the Prosecuting Attorney. Upon further investigation, the officer determined this was not the appropriate offense, according to magistrate court records.
Noel Santana Garcia, 44, of Frank, pleaded guilty August 20 to two counts of destruction of property. He was assessed a $200 fine, $321.60 in court costs, a $25 arrest fee and ordered to pay $300 in restitution. He was sentenced to 12 months in jail, to serve 120 days with credit for time served and placed on two years unsupervised probation.
Randall E. Bibb, 57, of Marlinton, had his bond revoked August 20 on charges of battery and stalking. Probable cause was found on a charge of failure to register as a sex offender and the case was transferred to circuit court August 20.
Timothy Martin Tingler, Jr., 23, of Circleville, pleaded no contest August 19 to a charge of driving suspended/revoked for non-DUI. He was assessed a $100 fine and $160.80 in court costs.
Jamie Darlene Teter, 31, of Marlinton, pleaded guilty August 19 to charges of DUI with child endangerment and possession of a controlled substance. She was assessed a $300 fine, $361.60 in court costs and $85 in additional fees. She was sentenced to two years unsupervised probation with credit for time served and will be drug tested at random by Day Report.
A charge of providing to a minor against Charlie Marie Waugh, 28, of Marlinton, was dismissed August 19 per oral motion of her defense attorney. A complaint was not on file.
A charge of fleeing in a vehicle while DUI against Greg C. Sharp, 26, of Cass, was transferred to circuit court August 19. The preliminary hearing was waived by motion of defendant with the advice of his defense attorney. Sharp must report to Day Report for bond supervision.
